1. About these terms

These Terms & Conditions ("Terms") apply to your use of www.indiabobbles.com (the "Site") and any purchase you make on it. The Site is operated by Rudra Softtech LLP ("India Bobbles", "we", "us"), H104, Ajnara Daffodil, Sector 137, Noida, Uttar Pradesh – 201305, India.

By browsing the Site, creating an account or placing an order, you agree to these Terms and to our Privacy Policy, Shipping & Refund Policy and Payment Options, which form part of these Terms. If you don't agree, please don't use the Site.

2. Who can use the Site

You must be at least 18 years old and able to enter into a binding contract under Indian law to create an account or place an order. If you're under 18, you may use the Site only under the supervision of a parent or legal guardian, who must create the account and place the order.

3. Your account

• You log in with a one-time passcode (OTP) sent to your email. Keep access to your email secure, and don't share OTPs with anyone. We will never ask you for your OTP.
• You're responsible for activity on your account and for keeping your details (name, email, mobile, address) accurate and up to date.
• Tell us immediately if you think someone else has used your account.
• You can ask us to close your account at any time (see section 22).

4. Our products

• Handmade: our bobbleheads are sculpted and hand-painted by artists. Small variations in colour, finish and detail from the photos are a natural part of handmade work, not defects.
• Photos and colours: we try to show products accurately, but colours may look different depending on your screen.
• Sizes and weights on product pages are approximate.
• Materials: products are made of polyresin or PLA, as stated on each product page. They are fragile collectibles, so handle with care.
• Availability: stock is limited and products may sell out. "Notify me" alerts don't reserve a product for you.
• Our characters are original artistic creations and caricatures made for fun and collecting. Unless clearly stated, they are not endorsed by, or affiliated with, any person, film or studio.

5. Prices & payment

• All prices are in Indian Rupees (₹) and include applicable taxes. Shipping within India is free unless shown otherwise at checkout.
• We may change prices at any time, but changes won't affect orders we've already confirmed.
• If a product is listed at an obviously wrong price because of an error, we'll contact you before shipping. You can pay the correct price or cancel for a full refund.
• We accept credit and debit cards, UPI, net banking and cash before delivery. Cash on delivery is available in New Delhi only. See Payment Options.
• Online payments are processed securely by our payment gateway partner (PayU). We do not store your card or bank details. Cards issued outside India are charged in ₹, and your bank converts the amount.

6. Orders & cancellations

• When you place an order, we'll send a confirmation email. A contract is formed when we dispatch your order.
• We may decline or cancel an order, for example if a product is out of stock, there's a pricing error, payment fails or we suspect fraud. If you've already paid, we'll refund you in full to your original payment method.
• Cancelling: you can cancel a ready-made order free of charge before it is dispatched by contacting us. After dispatch, our return policy applies. Custom orders can't be cancelled once work has started, because they are made just for you.

7. Shipping & delivery

• We currently ship only within India, mainly through DTDC. Some PIN codes may not be serviceable.
• Orders are usually prepared within 2 business days. Delivery normally takes 2–3 days to metro cities and up to 8–10 working days elsewhere.
• Delivery times are estimates. We're not responsible for delays caused by couriers, weather or other events beyond our control, but we'll help you track your order.
• Please give a complete, correct address and phone number. If a delivery fails because of incorrect details or repeated unavailability, re-shipping may be charged.

8. Returns, refunds & damage

• Returns: you can return a ready-made item within 7 days of shipment if it is unused and in its original packaging, with all tags and instructions. You pay the return shipping.
• Refunds for returns are given as store credit (excluding taxes and shipping charges), processed within 72 business hours of receiving the item.
• Damaged in transit: email clear photos of the item and packaging to indiabobbles@rudrasofttech.com within 4 hours of delivery, with your order number. We'll arrange a replacement or a refund (excluding shipping charges). An unboxing video makes claims faster.
• Wrong or defective item: contact us, and we'll replace it or refund you in full.
• Custom bobbleheads can't be returned unless they arrive damaged or defective.
• Full details are in our Shipping & Refund Policy. Nothing in these Terms affects your rights under the Consumer Protection Act, 2019.

9. Custom bobbleheads

• Quotes: we provide a quote with price and timeline before starting. Work begins only after you accept the quote and pay [in full / the advance stated in the quote].
• Your photos: you confirm that you own, or have permission to use, every photo you send, and that every person shown has agreed to being made into a bobblehead (or, for a child, their parent or guardian has agreed).
• What we won't make: we may refuse any request that is offensive, obscene, hateful or defamatory, impersonates someone to deceive others, uses a celebrity's likeness or a brand's logos or characters without permission, or breaks any law.
• Likeness: our artists aim for a fun, recognisable caricature, not a photographic copy. We share the design for your approval before finishing. Once you approve, we can't make further changes free of charge.
• Timelines in quotes are estimates. Tell us your deadline when you order.
• Showcasing: we'll only show photos of your custom piece on our website or social media if you give us permission.

10. Offers & coupons

Discount codes and offers are subject to their stated conditions (validity dates, minimum order, eligible products). Unless stated otherwise, only one code can be used per order. Codes can't be exchanged for cash. We may withdraw an offer or cancel orders that misuse codes.

11. Your content

If you post or send content to us, such as blog comments, reviews, chat messages or photos, you confirm it's yours to share, it's accurate, and it doesn't break any law or anyone's rights. You keep ownership of your content. By sharing it publicly on our Site, such as blog comments, you give us a non-exclusive, royalty-free licence to display it on the Site. We may remove any content that breaks these Terms.

12. Acceptable use

You agree not to:

• use the Site for any illegal or fraudulent purpose, or place fake orders;
• post content that is abusive, obscene, defamatory, hateful, misleading or that infringes others' rights;
• try to hack, overload or disrupt the Site, or bypass security features such as captchas;
• scrape, copy or reproduce our content, images or designs without written permission;
• resell our products commercially without our written agreement;
• impersonate any person or misrepresent your connection to anyone.

13. Intellectual property

The Site and its original content, including character designs, artwork, comics, blog posts, photos, logos, the "India Bobbles" name and the Site's features, are owned by India Bobbles or its licensors. They are protected by copyright, trademark and other intellectual property laws. Buying a product gives you ownership of that physical item. It does not give you any right to copy, reproduce or commercially use our designs or characters.

14. Links to other sites

Our Site may contain links to third-party sites and services, such as payment, courier, chat and social media, that are not owned or controlled by India Bobbles. We have no control over, and assume no responsibility for, their content, privacy policies or practices. We strongly advise you to read the terms and privacy policy of any third-party site you visit.

15. Product safety

Our bobbleheads are decorative collectibles, not toys. They are recommended for ages 14 and above. They may contain small parts and springs, and can break if dropped, so keep them away from young children and pets. Follow the care instructions on each product page.

16. Limitation of liability

• We provide the Site "as is" and don't guarantee it will always be available or error-free.
• To the extent permitted by law, we're not liable for indirect, incidental or consequential losses, such as loss of profit, data or opportunity.
• Our total liability for any claim relating to an order is limited to the amount you paid for that order.
• Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

17. Indemnity

You agree to compensate India Bobbles for any loss, claim or expense, including reasonable legal fees, that results from your breach of these Terms, your misuse of the Site, or content you provide (including photos for custom orders) that infringes someone else's rights.

18. Suspension & termination

We may suspend or close your account, or refuse service, if you breach these Terms, misuse the Site or act fraudulently. Where reasonable, we'll tell you why. You can stop using the Site and ask us to close your account at any time. Orders already placed and paid for will be handled under these Terms. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnity and limitation of liability.

19. Events beyond our control

We're not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, extreme weather, epidemics, strikes, courier disruptions, internet outages or government action. If such an event affects your order, we'll let you know, and you can cancel for a refund of anything paid for products not delivered.

20. Governing law & disputes

These Terms are governed by the laws of India. We'd always like to resolve problems directly, so please contact our Grievance Officer first. Subject to your rights to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, the courts at [Gautam Buddh Nagar (Noida), Uttar Pradesh] will have exclusive jurisdiction.

21. Changes to these terms

We may update these Terms from time to time by posting the new version on this page and changing the "Last updated" date. For significant changes, we'll notify registered users by email. Changes don't apply to orders already placed. If you continue to use the Site after changes take effect, you accept the updated Terms. If you don't agree, please stop using the Site.
